Delhi High Court: Ban lifted on OnePlus One Sale.

Previously Micromax filed a case against OnePlus for using Cyanogen branding and software for its OnePlus One, despite Micromax’s exclusive agreement with Cyanogen for its YU series of phones. For this reason, OnePlus One was temporarily banned by the High Court of India on 16th of December. Yesterday the ban has been lifted and few insights on the case are discussed ahead.

Sale of OnePlus One is now resumed in India but during the injunction only existing stock was allowed for sale. Import of new stock, and selling it was banned. The judges, Pradeep Nandrajog and RK Gauba, said in court order that the appeal for ban has been set aside, and the case will be heard and new orders will be declared on January 7. Until then OnePlus can continue to sell phones in India.

Firstly, only Micromax appeal was considered in court. This became the cause of immediate ban but later various statements were made by OnePlus in defense. One logical argument is that the Yureka phone is being sold at INR 8,000 while the OnePlus One prices INR 22,000 and thus neither competes with each other. In addition to this, OnePlus also claims of using Cyanogen 11s version of the OS, while Micromax is using only the Cyanogen 11 version on its Yureka phones.

Both companies are asked to file written copy of their statement till January 7.
